The Greene County Board of Commissioners met in joint session with the Snow Hill Town Board on Monday, July 17, 2006 at 6:00 p.m. in the Greene County Office Complex. Present for the County were Chairman Mary Betty Kearney, Vice Chairman Denny Garner, Commissioners James Fulghum, James Shackleford, and Jesse Tyndall. County Manager Don Davenport, County Attorney Borden Parker and County Deputy Clerk Lisa Johnson were also present. For the Town of Snow Hill were Mayor Don Davis, Town Administrator Bob Clark, Commissioners Allison Thomas, Geraldine Shackleford, Phyllis Burruss, Percy Edwards and Town Clerk Mauren Baker. Commissioner Washington was out-of-town.
The Chairman called the County Commissioners to order.
Mayor Davis called the Town Commissioners to order.
Commissioner Percy Edwards gave the invocation and Commissioner Fulghum led the Pledge to the Flag.
On motion by Commissioner Tyndall, seconded by Commissioner Edwards both Boards unanimously approved the agenda.
Chairman Kearney welcomed the Snow Hill Town Board and advised the purpose of the meeting was to discuss water tank maintenance.
Mayor Davis noted that impressive accomplishments have been made when the Boards work together.
Mayor Davis asked for roll call/introductions around the table.
Mayor Davis asked the Town Board if Lisa Johnson, County Deputy Clerk could take the minutes for the Town Board as well as the County. There was consensus from the Town Board.
Mayor Davis then turned the meeting over to Van Lewis with McDavid Associates for a presentation on the water tank maintenance and proposal.
Mr. Lewis presented a recommendation stating the following regarding the Snow Hill Water Tank #3.

In an effort to extend the cooperative relationship enjoyed by the Town of Snow Hill and Greene County we present the following proposal to the Snow Hill Board of Commissioners and the Greene County Board of Commissioners for their thoughtful consideration and mutual approval:
· Snow Hill Water Tank #3 on Hwy 13 North of Snow Hill will be leased to
Greene County for a term of 40 years for $1.00.
· During this lease Greene County would be responsible for all repairs and maintenance to Tank #3.
· No future cost sharing by Greene County on Snow Hill tank maintenance.
Commissioner Fulghum asked how the lines for the Town and County tied into the tank.
Mr. Mike Sutton noted that there is a “T” on the tank with a 10” line going to the Town and an 8” line going to the County.
Commissioner Tyndall stated that the County would need for the short section of the line to be incorporated into the lease agreement in order for the County to have access for draining purposes.
Mayor Davis advised that would be a friendly addition to the recommendation.
Mr. Lewis recommended that the lawyers for the County and the Town jointly draw up the lease agreement for approval by the Boards.
Commissioner Thomas questioned if this was a transfer of ownership or a lease.
Mr. Lewis advised that it would be a term lease of 40 years for $1.00 and not a transfer of ownership.
Commissioner Thomas asked for clarification as to the Town’s need for the tank.
Mr. Lewis noted that as long as the Town serviced the South Greene Water Corporation, that the tank would be needed. Now that South Greene Water Corporation will be served by the County, the Town will not need the capacity filled by the tank. He also advised that if the Town did not shift the tank to the County, the County would not be able to service South Greene Water Corporation.
Mayor Davis stated that this was a very friendly solution to the issue and asked Commissioners for the authorization to proceed.
Commissioner Thomas advised that she wanted to be sure that the right thing is being done for the Snow Hill residents. She stated that there are two other possible options, 1) shut down the tank or 2) sell the tank.
Mr. Bob Clark stated that he had talked with Scotty Wilkins of Utility Services that if selling the tank, the Town could sell for $1.00 or up to the demolition cost, which would only be approximately $30,000 and not the fair market value of $800,000 – $900,000.
On motion by Commissioner Tyndall, seconded by Commissioner James Shackleford the Board voted unanimously to accept the proposal as presented for a 40 year lease for $1.00 from Snow Hill to Greene County for Snow Hill Tank #3 and that the Town Attorney and County Attorney would draw up the agreement to include a section of 10” line (Town) and 8” line (County) to accommodate tank #3.
On motion by Commissioner Burress, seconded by Commissioner Geraldine Shackleford the Town Board voted unanimously to accept the following proposal as presented and to include a section of 10” line and 8” line to accommodate tank #3.

· During this lease Greene County would be responsible for all repairs and maintenance to Tank #3.
